These Terms of Service ("Terms") govern your use of the PaceKit mobile application and the pacekit.app website (together, the "Service"), operated by PaceKit ("we," "our," or "us"). By creating an account, downloading, or using the Service, you agree to these Terms.
PaceKit provides real-time voice coaching for runners during training and races. Coaching is generated using your location, pace, heart rate, course data, and information you provide in your runner profile. The Service is provided for informational and motivational purposes and is not a substitute for professional medical, coaching, or athletic training advice.
You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.
You agree not to:
Running is a strenuous activity. You assume all risks associated with running and with using the Service during a run. You are solely responsible for your own safety and for following the rules of any race, event, or public space where you use the Service.
Consult a qualified medical professional before beginning any new training program or if you have concerns about your ability to exercise safely. Do not rely on the Service for medical, health, or emergency decisions.
Pay attention to your surroundings. The Service delivers audio coaching and should never distract you from traffic, obstacles, other runners, or race officials.
The Service, including the app, the website, the coaching personalities, and the race course data library, is owned by PaceKit and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. All rights not expressly granted are reserved.
If you provide feedback, suggestions, or bug reports, you grant us a non-exclusive, perpetual, royalty-free license to use that feedback to improve the Service. You are not entitled to any compensation for feedback you provide voluntarily.
After a race, you may choose to contribute your pace and elevation data to improve the course for future runners. If you contribute, you grant PaceKit a perpetual, royalty-free, irrevocable license to use, aggregate, and incorporate that data into its course data library. Contributions are not linked to your account and cannot be individually retrieved or deleted after submission. You may opt out of future contributions at any time.
The Service relies on third-party services including Apple (Sign in with Apple, HealthKit, the App Store), Supabase (cloud database and authentication), and AI providers used to generate coaching responses and speech. Your use of these services through PaceKit is also subject to their respective terms. See our privacy policy for details on what data is shared and why.
We may add, change, or remove features of the Service at any time. We may also discontinue the Service in whole or in part. Where practical, we will provide notice of material changes.
You may stop using the Service at any time and request deletion of your account by contacting us. We may suspend or terminate your access to the Service if you violate these Terms, misuse the Service, or for any other reason at our discretion. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that coaching will be accurate in every situation. Course data is compiled from public and official sources and may change or contain errors.
To the maximum extent permitted by law, PaceKit and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, personal injury, or property damage, arising out of or related to your use of the Service.
Our total aggregate liability for any claim arising from or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the claim, or (b) USD $50.
You agree to defend, indemnify, and hold harmless PaceKit from any claim or demand, including reasonable attorney's fees, arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute arising from these Terms will be resolved through good-faith negotiation first, and, if unresolved, in the state or federal courts located in Los Angeles County, California.
We may update these Terms from time to time. When we do, we'll update the "last updated" date at the top of this page. Continued use of the Service after changes take effect means you accept the updated Terms.
If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
